Fertilizer Price Fixing Lawsuit

Potential Fertilizer Price-Fixing Investigation

Direct Purchasers of Nitrogen, Phosphate, or Potash Fertilizers May Have Legal Claims

Our firm is investigating potential antitrust violations involving several of the largest fertilizer producers in the United States. If your business purchased nitrogen, phosphate, or potash fertilizers directly from companies such as:

  • CF Industries
  • Mosaic
  • Nutrien
  • Koch
  • Yara

you may have paid artificially inflated prices.

If you made direct fertilizer purchases from any of these companies, please contact our firm to learn more about your potential legal rights and participation in a possible lawsuit.

Federal Investigation Into Major Fertilizer Producers

Federal prosecutors in Chicago have opened an antitrust inquiry into several major fertilizer manufacturers, including Northbrook-based CF Industries. The investigation is focused on pricing practices within the nitrogen, phosphate, and potash fertilizer markets. Other companies reportedly under review include Mosaic, Nutrien, Koch, and Norway-based Yara.

Regulators are examining whether a small group of dominant producers may have engaged in conduct that inflated fertilizer prices. Because fertilizers are a critical agricultural input, any coordinated pricing practices could significantly increase costs for farmers and other direct purchasers, ultimately affecting food production costs across the supply chain.

Highly Concentrated Fertilizer Markets

The fertilizer industry has long drawn scrutiny due to its high level of market concentration. An analysis conducted by the Texas A&M Agricultural and Food Policy Center estimates the Herfindahl-Hirschman Index (HHI)—a common measure of market concentration—at approximately:

  • 2,382 for nitrogen fertilizers
  • 4,553 for phosphate fertilizers
  • 3,455 for potash fertilizers

These figures fall well within the range economists and antitrust regulators consider highly concentrated markets. In addition, a relatively small number of companies control the majority of domestic production capacity. Such conditions can increase the risk of coordinated conduct or pricing practices that harm purchasers.

Who May Be Affected

Businesses that purchased fertilizer products directly from major manufacturers, including:

  • CF Industries
  • Mosaic
  • Nutrien
